Centre Strengthens Witness Protection Scheme

The Ministry of Home Affairs has strengthened the Witness Protection Scheme to provide greater security, anonymity, and institutional support to witnesses involved in criminal proceedings. The move seeks to address long-standing concerns of witness intimidation, coercion, and hostility, which often undermine the delivery of justice in India.

Witnesses play a crucial role in ensuring fair trials and effective prosecution. However, fear of retaliation—particularly in cases involving organised crime, terrorism, sexual offences, and powerful accused—frequently leads to witnesses turning hostile or withdrawing cooperation. Recognising this vulnerability, the enhanced scheme builds upon the Witness Protection Scheme, 2018, which was approved by the Supreme Court to operationalise the right to a fair trial under Article 21.

Key improvements include enhanced financial allocation for witness protection measures such as relocation, change of identity, police escort, and installation of security devices. The scheme also strengthens anonymity provisions, allowing for in-camera proceedings, non-disclosure of witness identity, and use of technology such as video conferencing to record testimony where required.

Another important aspect is improved coordination with State governments and law enforcement agencies. States are encouraged to establish and strengthen Witness Protection Funds and designate competent authorities to assess threat perception and implement protection orders in a timely manner. Standard Operating Procedures (SOPs) have been refined to ensure uniform implementation across jurisdictions.

The scheme also emphasises judicial oversight, with courts empowered to pass appropriate protection orders based on threat assessments. By institutionalising accountability and monitoring, the Centre aims to reduce ad hoc implementation and ensure that witness protection becomes an integral part of the criminal justice process.

Strengthening the Witness Protection Scheme enhances the credibility and effectiveness of the criminal justice system. By safeguarding witnesses and preserving trial integrity, the initiative improves conviction rates, upholds the rule of law, and reinforces public confidence in judicial processes.
